Applicability conditions added/changed

Condition 25

imposes a minimum salary of $120,000 pa for footballers
replaces Condition 23 for ship’s masters and gas or petroleum operators

Condition 26

replaces Conditions 23 for recruitment consultants on the STSOL and reduces the annual salary required to $80,000

Five Year Parent Visa - from 17 April 2019

Minister Coleman has announced today that the new five year sponsored parent visa, the Subclass 870 Parent (Temporary) Visa, will be open for application on 17 April 2019.

Parents will be able to stay for up to five years at a time without departing and the Department has announced that up to 15,000 per year will be granted.

 

NB: The introduction of this visa is still subject to introduction of supporting regulations

 

Charges

  • Sponsorship application: $420

  • Visa application charge: $5,000 for 3 years duration, $10,000 for five years duration 

 

The visa application charge is payable in two instalments, with one payment at time of application and the remainder paid prior to visa grant.

 

Other features include:

  • No Balance of Family test will be applied

  • 'No work' conditions will be applied

  • Require health insurance 

  • Must provide evidence of access to funds

Working Holiday Maker Visas - third visa amendments

The maximum number of ‘working holiday maker’ visas increases from two to three, where the visa holder meets additional work requirements. 

The applicant is required to complete 6 months specified work in specified circumstances in order to be eligible for a third ‘working holiday maker’ visa. 

Applicants for third WHV must have undertaken 6 months specified work while holding a second WHV and that this work was carried out on or after 1 July 2019. 

This commences on 1 July 2019.

Three year WHV and changes to Seasonal Worker Program

Changes to Working Holiday Maker visas

• Work and Holiday makers (subclass 462) will be able to undertake regional plant and animal cultivation work in additional priority areas to become eligible for a second visa.

• Extension of the period a WHM (subclass 417 and 462) may work with the same agricultural employer from six to 12 months.

• Introduction of a third year visa option for WHM (subclasses 417 and 462), who from 1 July 2019 onwards complete six months of regional work in the second year.

• Increase the number of places available for Work and Holiday Maker program (subclass 462) by 
lifting annual caps available to a number of countries participating in the subclass 462 visa program.

These changes require a strict workforce test to be applied to ensure Australian workers are given the first opportunity for work.

WA to implement Skilled Graduate occupation lists

The Western Australian Government has announced that it will be developing a new occupation list for skilled graduates of WA universities.

High achieving education graduates - PhD, Masters, Honours and other higher degree graduates - will have a pathway to skilled migration, with priority consideration for State Nominated migration.  The introduction of this list is expected to also increase the number of international students choosing to study in WA.

The existing WA Skilled Migration Occupation List will not be affected.

Skilling Australians Fund commencing 12th August 2018

The Migration (Skilling Australians Fund) Charges Act 2018 (the SAF Charges Act) is an Act relating to the ‘nomination training contribution charge’ (the charge) payable by persons who are liable to pay the charge under the Migration Act 1958 (the Migration Act) and the Migration Regulations 1994 (the Migration Regulations).

The charge is imposed on employers who nominate workers for temporary (subclass 482) or permanent (subclass 186) skilled work visas.

SkillSelect Invitations - rounds now monthly

The Subclass 189 points tested visa stream and Subclass 489 invitation rounds have traditionally been run fortnightly. The Department has reviewed this process and will now extend invitations on a monthly basis. The invitation numbers will be increased accordingly, to ensure the number of applications received will maintain a strong pipeline for the skilled program. There are no other changes being implemented aside from moving to a monthly invitation process.

There is currently a very healthy pipeline of applications and we will continue to monitor those so we can make sure we invite an appropriate number each month.  The invitation rounds are not set in stone in terms of invitation numbers, they can fluctuate depending on our processing capacity and pipeline.

We have been allocated the same number of places in the Migration Program as last year and will continue to work as hard as we can to meet finalisations while maintaining our high level of scrutiny and integrity in the program.

The pro-rata occupations will continue to maintain the same split as previous to allow room for other non pro-rata occupations to also be invited.
